**Terms of Service for CHIAGIG**

Welcome to CHIAGIG! These Terms of Service (“Terms”) govern your use of the CHIAGIG website, located at [https://chiagig.com/], and any related services provided by CHIAGIG (“Service”). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference into these Terms. If you do not agree to these Terms, do not use our Service.

**1. Account Registration**

1.1. **Eligibility**: You must be at least 18 years old and capable of forming a legally binding contract to use our Service. By registering for an account or using our Service, you represent and warrant that you meet these eligibility requirements.

1.2. **Registration**: To access certain features of our Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3. **Account Security**: You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account. You agree to immediately notify CHIAGIG of any unauthorized use, or suspected unauthorized use of your account or any other breach of security.

**2. CHIAGIG Service**

2.1. **Description**: CHIAGIG provides a platform that connects freelancers with clients seeking various services (“Clients”). We do not provide the services offered by freelancers ourselves and are not responsible for the actions or omissions of users of our Service.

2.2. **Use of Service**: You agree to use our Service in compliance with these Terms, applicable laws, and regulations. CHIAGIG reserves the right to suspend or terminate your account if we suspect that you have engaged in fraudulent or illegal activity.

**3. User Content**

3.1. **Posting Content**: You retain ownership of any content you post or submit to our Service (“User Content”). By posting User Content, you grant CHIAGIG a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

3.2. **Responsibility**: You are solely responsible for your User Content and the consequences of posting or publishing it. By posting User Content, you represent and warrant that you have the necessary rights to distribute it and that it does not violate any third-party rights or these Terms. We confer on each user an additional responsibility to be polite, responsive, truthful and courteous to all users on the platform. Failure to be responsive to users without properly addressing them will be investigated and appropriately dealt with. If away, make that known to the user you are communicating with. If you are doing research on a client’s request, make that known to the client. Absolute non-responsiveness will easily get your account banned. Displaying and advertising false services and products will be not be accepted. Attempting to be in the middle of a gig here will also not be accepted.

**4. Payments**

4.1. **Payment Terms**: Clients agree to pay freelancers for services rendered through the CHIAGIG platform according to the terms agreed upon between them. CHIAGIG may facilitate payments between Clients and freelancers through third-party payment processors and may deduct a service fee from such payments. All payments are processed through (https://chiagig.xchpay.me/) and as such are subject to the terms and conditions of using (https://chiagig.xchpay.me/) to process payments.

4.2. **Disputes**: CHIAGIG is not responsible for any disputes between Clients and freelancers regarding payments or services. However, we may provide dispute resolution assistance at our discretion.

4.3 “We only accept payments in CHIA(XCH) Cryptocurrency on the CHIA Blockchain Network via our payment partner XCHPay. We offer 5% discounts on platform fees to those who contact us directly via our discord channel to assist them make payments using HOA, DEVIL & KING tokens from the CHIA Blockchain Network “

**5. Termination**

5.1. **Termination by Users**: You may terminate your account at any time by following the instructions on our Service. Upon termination, any outstanding obligations (including payment obligations) will continue to be your responsibility.

5.2. **Termination by CHIAGIG**: CHIAGIG reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

**6. Disclaimer of Warranties**

6.1. **As Is Basis**: The Service is provided on an “as is” and “as available” basis. CHIAGIG makes no representations or warranties of any kind, express or implied, regarding the Service or its availability, reliability, or accuracy.

**7. Limitation of Liability**

7.1. **Exclusion of Damages**: To the fullest extent permitted by law, CHIAGIG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

**8. Changes to Terms**

8.1. **Modification**: CHIAGIG reserves the right to modify these Terms at any time. We will post the revised Terms on our website and on this page. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised Terms.

**9. Governing Law**

9.1. **Jurisdiction**: We do not support nor provide any aspect of use of our platform to the following countries, Iran, Iraq, Korea, Libya and Syria

Apart from the countries stated above, all other countries are permitted to use our platform and are subject to our terms and conditions. These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law principles.

11.**Fees**

We employ a 15% fee on gigs and it’s only taken out of seller’s payout.  Buyers don’t have to pay any fees for making a purchase. The 15% is deducted from the total earnings on each gig before making payouts to sellers.

Payment servers are a bit slow so you might have to proceed with patience. You can use Goby wallet for ease of use.

System will automatically detect when transaction is confirmed so you have to wait patiently for confirmation before going back to the homepage.

Soliciting of payments outside this platform is strictly forbidden and only the payment method provided by the platform is approved. If a seller or buyer requests you to transfer funds or accept funds using payment channels outside of this platform, both accounts can be permanently restricted for violation of terms.

All communication should be on the platform. Sending of private chat links, emails and other mode of communication is strictly forbidden. Both seller and buyer who proceed to communicate outside of the platform are in violation of our terms and will have their accounts banned”

**12. Payouts**

We only remit in CHIA(XCH) Cryptocurrency on the CHIA Blockchain Network. Note that we do not remit Dollar or other currencies’ equivalents because of fluctuations in prices. We only remit in CHIA(XCH) cryptocurrency. Hence note that your payout’s current dollar rate at the time of payout’s may be more or less depending on the current market prices but your Crypto amount remains constant on our platform. (Note your crypto amount is the total amount received from buyer minus platform’s fees)”
